It is understood, however, that when the contract

was under discussion between the Engineers and the

Contracter, before being signed, it was mutually agreed that rubble should only be substituted for

sand in the event of an insufficient supply of sand

being obtainable by the Contractor er if it was not possible to obtain sand of a suitable quality for

the work.

As it has been proved that sand in sufficient

quantity and of suitable quality can be provided,

it is considered that under these circumstances,

the Contractor can fairly claim to be paid $1.90 per cubic yard for the rubble deposited in the trench, although under the actual wording of the

Contract he is only entitled to $1.10 per cubic

yard.

Item 31- It is evident that when this wall was designed,

settlement was anticipated and sloping blockwork was secordingly adopted to allow for it. From an inspection of the material on which the mound is being founded, it is considered that it is sufficiently solid to take the weight of the

mound and wall without settlement, but when the pressure due to the weight of the wall and the filling behind it comes onto the rubble mound it will compress and a general settlement will take place, the amount of which it is net pessible to estimate accurately, but it will probably be

considerable.

This settlement will take place gradually and will

not finally cease until after the wall has been

backed up, and is taking the surcharge that has

been allowed for in the designing of the wall,
